No Win No Fee

The phrase ‘No Win No Fee’ is one which you hear cropping up time and again when personal injury claims are being discussed, but it’s one which is often misunderstood and needs to be properly grasped if you are about to take the decision to embark upon a personal injury compensation claim.

Many people make the mistake of thinking that no win no fee means that a claim is guaranteed to be won. Unscrupulous companies might choose to take advantage of this misunderstanding in order to lead people into thinking that they are bound to win. In truth, no such promises can be made.

At CompensationClaim.com we will always do our best to seek compensation for our clients, and only ever take on cases which we think have got a very good chance of winning. What no win no fee actually means is that the element of risk is removed from making a compensation claim. In the past, people who were injured in an accident which was no fault of their own might have felt they ought to be compensated, but felt afraid to launch a case for fear of the fees, court costs and expenses they might end up owing if they happened to lose. Thus, in the days before no win no fee claims, compensation was something which wasn’t always rewarded on the basis of need or justice, but was instead something which was the province of only those rich enough to take the chance of losing. The no win no fee system removes that risk, and opens up the chance of justice and fairness to everybody.

A compensation claim for personal injury relies upon establishing two basic facts. The first is that an accident of some kind has taken place, and that it wasn’t your fault. It could be a car accident, an accident at work, a trip or a case of medical negligence, but the bottom line is that if you have been affected by an accident which was caused by someone else’s negligence, then you should be able to claim compensation. The second basic fact which has to be established is that you’ve been injured in some way by this accident, and that this injury is having a detrimental effect upon your life. We’ll build a case centred upon establishing these two facts, and we’ll fight it on a no win no fee basis, a system which will protect you no matter what the result of your case.

If you should happen to lose a case fought under the no win no fee basis, then you won’t be out of pocket at all. Your lawyers’ fees and any costs demanded by the other side will be covered by insurance, meaning that the issue of costs is not one you have to consider when choosing whether to make a claim or not.

If, on the other hand, you should win a case fought under no win no fee (something which we always go out of our way to ensure), you’ll receive every penny of the compensation which the judge awards, with your own injury lawyers fees being paid by the other side.

Under no win no fee, the decision to launch a compensation claim can be made bearing in mind nothing other than the rights and wrongs of the case, and the fact that you are entitled to compensation.
